Recent censorship in Mongolia

with the illegal privatization of the Urgoo Hotel property. He is currently being held in the Tuv aimag Detention Center.

Head of the Legal Department of Parliament B. Odbayar issued the following statement; “ We have received your demand and will pass it on to the legal department of region concerned.”

The MPRP, lead by General Secretary N. Udval, has stated that the response is not satisfactory and that they will now proceed with the next stage of their demand. What this stage is remains unclear at this time.

N. Enkhbayar served as the third President of Mongolia from 2005 to 2009. In 2010 when the Mongolian People’s Revolutionary Party, of which he was a member, elected to change their name to the Mongolian People’s Party N. Enkhbayar did not support the decision. He split from the group to form the new Mongolian People’s Revolutionary Party, which was approved by the Supreme Court on June 24, 2011.

What a weak article .it shows a complete lack of understanding of what really happened regarding the creation of the MPP and the politics of the IAAC.Enkhbayar took the MPRP name because it was vacant after he lost the Presidential election. A stronger faction within the then MPRP got rid of him by simply not rigging the election as they usually do.
Enkhbayar has an estimated wealth of over $100 million mostly generated from his time as Prime Minister when he was syphoning off $10million per annum from Erdenet.Everyone in Mongolia knows what he and his family own and the placement of his people in key positions. He told the IAAC that he only owned one apartment in UB and a saddle given to him George Bush!
The IAAC was only created as a requirement for the MCA money to be supposedly available to Mongolia. Mongolia now has 4 investigative units the IAAC,                                                                                                                                                                                          GIA, Criminal Police and a unit within the GPO.
The first head of the IAAC B.Dangaasuren was found dead in Sydney 3 days after the signing of the MCA documents in US, the second head Sangaragchaa was the former Director of Gandshudag Prison unfortunately for him he is a prisoner there now after being sentenced to 2 years and four months jail. The former spy chief Khurts after being arrested in UK and sent to Germany for trial was released one week before Merkels came to Mongolia to sign a rare earth minerals deal. Khurts was cut loose by the MPP and did a deal with the Democrats who now control the IAAC.Khurts was made Deputy of the IAAC. This has more to do with payback and the many people within Enkhbayar’s former party who are determined to get him.
And what about the Americans? The Asia Foundation that pretend aid organisation founded by the CIA in 1951. They monitored the 2008 election which Enkhbayar admitted in the UB post this week was corrupt. TAF declared the election free and fair and surprised by the degree of rigour. But what would you expect from Bill Infante. He and his wife opened up Breakthrough PR in 2008 while Bill was still in office at his not for profit TAF. This agency is helping itself to the $31 million dollars earmarked for consultants by the MCA administered by the MCC in Mongolia. And what about the previous Director of TAF in Mongolia Layton Croft it seems he is now a Director of Ivanhoe mines what a strange career path to go from an "aid" organisation to an organisation such as lvanhoe.

Yes, elect me as President, I will do much better job than our current cowardice president who arrested Enkhbayar without a warrant because he was afraid that Enkhbayar will release information that actually shows what happened in July 1st.

hahah talk about sensitivity! Lol seems like people here are very sensitive to supporters of enkhbayar. Please don't stray from the topic and make it personal. Its quite sad how you people make stuff up then believe it yourselves. Anyway, if you are so against Enkhbayar the lets see how Elbegdorj does as president and you'll be sorry. And Ochir, what makes me a "dictator"? do you even know what that means?
Enkhbayar should be happy that he has supporters like me since people like me are not afraid to use "colorful language" as so-called "A Mongolian" says, to tell people what actually happened and how the arrest was completely illegal (since there was no warrant) without trying to sound smart and make false statements.

Its funny how you people make it personal whenever I am trying to talk about the politics, (what this article is about). Clearly, you have no idea about what actually happened but are just against Enkhbayar so it is pointless to argue. Anyway, what can you do, no matter where you are, there is going to be ignorant fools like you. But i'm not worried, i'm sure you will have no impact on anything at all.

Thanks for the informative comment. I agree this article is seriously poorly written. UB Post needs to stop hiring some ill-informed westerner to write stories like this. Appalling!

Because of your comment, it made think. I was concentrated on the arrest but now I see what is really going on. I gotta thank you for that.

As you know, since the early 1990s all these charities, non-profits, churches and foundations started to appear in Mongolia. It is never clear exactly what they do for Mongolia and why they are there. I remember once approaching a Christian church in a suburb of Mongolia. I was just curious. Most churches in the UK are open to public and you can just go in to look around. But before I even come close to the church, a jeep pulled over and then a foreign looking man came out and literally shouted at me. Mmm...was it actually church? I don't think so. He looked more like a businessman. Anyway, I have many suspicions over these western organisations. I just hope that the we are keeping a tab over them.

I really support Enkhbayar and am of the opinion that corruption in Mongolia has stretched its limits too far. This obvious political targeting, highlighted by the brutal force on the seemingly force of 'justice' amalgamates the politics in Mongolia by the current heads, corruption bribery and any resorts to stay in power. As a normal mongolian citizen, under Enkhbayar i felt there was much more prosperity and stability in Mongolia. With increasing Foreign Direct Investment, which Enkhbayar initiated and improvement of infrastructure, which is essential for a sparsely populated country as us (Millenium Road, or Myangani Zam), there was definitely a period of non-corrupted growth. I will never forget how he settled our debt with over 100 million to Russia, by agreeing to pay less than 2%, unheard of figure for a former communist country.

Under Elbergorj, there was the massive oil crisis, which was obviously because Russia did not get a part of some massive deal the politicians offered, the whole country suffered. Look at the feuds, Nyambordj, Bayar, and look at the Chinese, Russians and Americans taking over our whole economy, and deriving from that political and social system as well. I remember, Enkhbayar insisted on an above 50% share of Tavan Tolgoi, but the current politicians gave it away for 30%.

The facts speak for themselves, and no matter what Enkhbayar was under state immunity for 4 years after his term as a President. Furthermore, when i watched it on live TV, the brutal force of the police emanates corruption and obviously political order from above.

ENKHBAYAR PLEASE BE RELEASED SOON, YOURE OUR ONLY POLITICIAN NOTE WORTHY.

The Millennium Challenge account was always empty from the start it now is massively underfunded and the largest part $183 million for the jointly owned Russian/Mongolian railway won’t happen because of the refusal to conduct an audit as required by the MCC.
Enkhbayar didn't pay back the debt to Russia; do you remember the payment of $250 million when $50 million disappeared via a third eastern European country? This story was called "The 31 corruptors of Mongolia" and alleged that the missing money was divided up between the then MPRP. Bayar took legal action in an attempt to clear his name.
As for Tavan Tolgoi do you also remember that it was owned by a consortium of 14 Mongolian companies until the MPRP imprisoned the Mongolian CEO and seized Tavan Tolgoi only to sell it to the highest foreign bidder. As for the creation of Erdenes Tavan Tolgoi this holding company will steal the shares the same as the Erdenet holding company did again cheating the Mongolian people out of their shares.
The oil crisis has more to do with Putin and his `3 private companies that want control of Mongolia’s uranium. he is using a big stick to get what he wants and Mongolia as usual gives the Russians whatever they want.

This whole process is such an oppressuive manifestation of illegality! If he is not a suspect they have no right to detain him! According to the Criminal Code of Mongolia Enkhbayar should be allowed to be released on bail. The Agency claims that they have called Enkhbayar several times for questioning but her never showe up. Well that is just ludicrious. So when he does not show up they deploy 600 policement and physically assault a person. What great demonstration of Justice. Do you guys know that the current head of the Prosecution Office, under which is the IAAC and the police, is Khurts? The one who was arrested and in prison in UK. Then Elbegdorj and Batbold asked Angel Merkel on her visit here to release him, and now he heads this Agency, placed in position by Elbegdorj. Obviosuly he owes a bunch to Elbegdorj. Do you guys also know that Amarbat, the current head of the IAAC had criminal conviction of rape behind him? They even had evidence, but he was never charged.

Enkhbayar, if people claim he was corrupt, then his scale of corruption was a drop of water compared to the current policitians. He wanted for the state to own 50% of the Oyu Tolgoi and Tavan tolgoi! But the current politicans, being the greedy old men they are, had opted for 30% stake because the foreigners had promised them individually a share in the projects. Remember about 2 years ago we got cut all oil from Ulaanbaatar? Why did Russia suddenly stopped oil importation to us, so that we actually had to ride horses in the city? Becuase obviously the current politicians had promised the Russians a stake in the projects and could not fulfill it. That is the only explanation.

The coalition governemnt, Democratic Party and MPP are all selling away our country to foreigners, because all they are about is their own well being as if they are not rich enough. People criticise that all of them are corrupt etc, well we do not have a non-corrupt one, or a completely pure one. Our choice is limited, and the best one we have right now is Enkhbayar. No matter what people say you cannot play with peoples lives, like they did with Enkhbayar. What is so wrong with him running in the elections? If people want him, they want him. The current politicans are just cowards, bickering among themselves. I hope Enkhbayar comes to power and puts ALL of them in prison. Sick of the current governemtn so much.

The prosecution office, the IAAC and the Police are separate entities Khurts has been appointed deputy of the IAAC. l agree a deal has definitely been done. This deal was done before Merkels came to Mongolia as Khurts and Elbegdorj flew back to UB reportedly on the same flight one week before her visit. i agree with most of what you say but I can't share your support for Enkhbayar. Over 40,000 public figures had to give financial statement to the IAAC most of them are false are all these people going to be arrested as well?
Tavan Tolgoi was 100% owned by 14 Mongolian companies until 2007 previously the lease was held by BHP who sold it in the 1990's and now have closed their office in UB.It doesn’t matter what percentage of TT is "given "to the Mongolian people it will be corrupted and won't happen fairly. The share for the people had been raised from 10%to 20%.
If Enkhbayar is given bail he will probably leave the country. He and Batbold allegedly have nice houses in Knightsbridge London. Most Politicians corruption is within the 1-3 million range but Enkhbayar is in a league of his own with over $100 million.

Excuse me, but seriously where do you find these figures of Enkhbayar's net worth of more than 100 million dollars? I think you just made up that number. No where on the media, Mongolian or foreign, is mentioned that Enkhbayar is THAT rich. And be realistic, if he was that rich, he would not be in prison for more than ten days. People fear rich people, and certainly our cowardice president Elbegdorj doesn't have the guts to put a powerful politician with net worth of more than $100 million dollars in prison. Please don't make up false accusations, this is not true.
I completely agree with "A Mongolian Citizen", Enkhbayar's level of corruption is nothing compared to Elbegdorj and Batbold etc. It is incredibly obvious and anyone with at least some knowledge will immediately see that his arrest was purely political and took place because our current leaders do not wish for Enkhbayar to become prime minister. Our government is going too far. President or not, Enkhbayar is a human being, and a "democratic" government cannot put a man in prison without a lawyer nor refuse to release him on bail. This is quite outrageous. I can't believe you are against Enkhbayar. Did you not watch how his arrest took place? Millions of Mongolians watched it and support Enkhbayar but are too afraid to say anything because the person who organized the protest to release Enkhbayar has been imprisoned as well! Please think with your head and realize that Elbegdorj is trying to do everything in his power to stop Enkhbayar.
I completely support Enkhbayar because he is a person who actually cares for his country. He wanted Mongolia to own 51% of Oyu Tolgoi but Elbejdorj is happy with 36% as long as he is benefiting from it.

Altai ,Enkhbayars assets and money are well documented in Baabars books. and some of the financial staements tp the IAAC have been made public, it is not a competition to see who is the most corrupt. Enkhbayar has no chance of becoming Prime Minister the MPRP after the name change is just an empty shell.Enkhbayars 4 year immunity from prosecution is over and he is now in jail. I did watch how the arrest took place it was surprisingly calm .It was stage managed quite well by TV9 and very interesting to see who was with him,the former head of the Mongol bank,the head of the cashmere company and the ex wife of Bayar.Of course Elbegdorj and others within his former party are trying to get him. It is only 4 years since they tried to kill Elbegdorj and killed his driver by mistake by ramming a motorbike with no lights into his car.Lets see the evidence from Tsolmon that the 2008 election was corrupt.

Well please share the link in Baabar books because the 100 million dollar figure is nowhere in the media. And if it was actually in the books, it would already be in the media. Furthermore, if his net worth was actually that much, the evidence would already be revealed after he is in prison for more than ten days. This is a groundless accusation. And as I stated before, our current politicians don't dare to imprison a person with that much money and influence. In addition, Enkhbayar's 4 years of immunity is NOT over, he stopped being president in 2009, which means he has immunity until 2013. The government has no right to imprison someone who has immunity. You clearly live in your own world, it was clearly not staged, do you think Enkhbayar will willingly go to Mongolia's most notorious prison? And who is "they"? Elbegdorj got into an accident because of his own bad deeds and bad karma. I really feel that you are just saying everything you can to fool people that Enkhbayar is a bad person. You must be paid to write this, otherwise, it is quite stunning that you are so against Enkhbayar while Batbold and Elbegdorj get away with so much corruption and are much, MUCH wealthier and think they are above the law.
Why are you deliberately ignoring my factual points? Like how Elbegdorj allowed foreign companies to own 64% of Mongolian minerals and how the Mongolian government imprisoned people who are organizing protests to release Enkhbayar. Aren't we a "democracy"? I didn't say that it was a competition, but doesn't it strike you as suspicious that 600 policemen are attacking one politician while so many other corrupt politicians are being searched at all? Obviously, our current rules are afraid of enkhbayar; afraid that he will reveal information regarding their corruption.

Enkhbayars wealth has been discussed widely in the Mongolian media but not much in the controlled English language media. Of course a large part of Mongolian media such as TV9, Zunee Medee, and Ulaanbaatar Times probably wouldn’t cover it because they are owned by Enkhbayar and his family. Enkhbayar and his family own the Trade and Development Bank, the Agricultural Bank, Aeromongolia (before its demise) and a large spa resort. He is also alleged to be a silent partner in MCS one of Mongolia’s biggest companies with large construction and property interests along with the Coke, Tiger beer and Xara vodka licenses. This is on top of the recent controversy regarding the Urgoo Hotel development and the acquisition of the UB Times. Baabar’s books are well read in Mongolia you can find them at most bookstores and are usually published by Nepko I’m sure you know them.
You misunderstood my meaning of the arrest being stage managed they obviously had a cameraman present inside his apartment.
Regarding Enkhbayars immunity from prosecution please read the comments from Ch.Unubayar: - “The former President Enkhbayar’s full authority has ended. The Government and Parliament granted him level 3 protection. This level of protection does not make him immune to being a suspect in crimes and their investigation procedures.” Enkhbayar clearly does not have complete immunity and he isn’t protected against public comment by law like he was when President. The UB Post article on April13”Mongolia’s Third President Arrested” claims that Elbegdorj defeated Enkhbayar in the 2008 elections. This of course is incorrect as 2008 was the general election and 2009 as you rightly point out was the presidential election. The UB Post also claimed that the former MPRP building was burnt to the ground, this is also false; it was damaged by fire but not burnt to the ground. There will be more evidence to come out as a lot of people have been doing a lot of work behind the scenes.
If you think Elbegdorj’s accident was the result of bad karma then l suggest that this bad karma has now landed on Enkhbayar. Who are “they “probably the people who didn’t want Zorig or Elbegdorj to win the next elections? Narantsatsralt another former democrat Prime Minister died in a car “accident” at exactly the same time as Elbegdorj’s “accident “what an amazing coincidence that both men were a victim of this karma at the same time?
Elbegdorj had plenty of time to consider who “they” were when he was recovering in an American Hospital. Mongolia is a sham democracy its legal system is still inquisitorial and draconian after they failed to implement Professor Chimid’s new constitution. Any legal questions are referred to a group of 6 Supreme Court Judges appointed by the president for “interpretation”. Will the MPP (then MPRP) close all TV stations except MNB and shutdown the internet like they did during the aftermath of the 2008 “election”? Mongolia’s elections are more like a circus with widespread corruption and false promises to the Mongolian people including the $1300 shares in Bayan Mongol promised to every Mongolian by the MPRP at the last election. What happened to those shares? I was told this promise didn’t count anymore as the MPRP had changed its name to the MPP! This process is then endorsed by the Asia Foundation founded by the CIA in 1951 as the Committee for Free Asia as electoral observers what a joke. Mongolia is hiding behind the “emerging democracy” and “transition period “phrases it takes money for supposed reform then doesn’t fully implement the reforms.
Enkhbayar is irrelevant to the future of Mongolia; the best hope is that some of his money can be returned to the Mongolian people. Many people enjoy influence and good jobs because they were placed there by him. Slowly these people will be replaced and the situation might improve slightly? It sounds like you are more scared of money than the truth? I note that it took a female judge to sign the warrant against Enkhbayar. I congratulate her on her courage in a country where so many men are scared of people with money.

so if you are so damn intelligent and all knowing about the corruption of others, why don't you share some numbers with us all. Maybe you can even go and share those so called facts with the IAAC. Tell me how exactly elbegdorj allowed foreign companies to own 64% of all mongolian minerals? I didnt even know we had a set number for the quantity of minerals in Mongolia. You talk of false accusation and such but you are the are the only one who is doing that in this thread of comments. What proof do you have of elbegdorj being corrupt and where does he even fall into this arrest of enkhbayar? The IAAC arrested a politician that was corrupt and if you stop being so ignorant and closed minded maybe you can read and see the statements that were made by the IAAC and the police. They did have a warrant. If enkhbayar was not corrupt and all peace loving, why didnt he just go to them and give them a statement.

Interesting to see Enkhbayar’s son on TV saying that they have been denied access to him then seeing the footage from Caak.mn of the previous day with him at the “hospital” that he is staying in. Tsolmon was also there showing Enkhbayar the rooms and where he could do his cooking. As in Gandshudag there is a two tiered structure of accommodation for those with money.

Also very interesting to see the investigation of an apparent $50 million “loan” to Enkhbayar from Ivanhoe to secure 40 licenses. Does this mean that the licenses could be invalid and the result of a corrupt process? Perhaps Friedland could be called to explain this?

On Monday at 10 a.m., the trial of the Head of the Mongolia People’s Revolutionary Party N.Enkhayar begun, at the Sukhbaatar District Court. The trial was overseen by S.Soyombo-Erdene, and the acting judges were M.Aldar and S.Oyunchimeg. Outside the court, N.Enkhbayar’s party’s board, his son E.Batshugar and other affiliates gathered to support N.Enkhbayar. The Sukhbaatar District Police provided security.
N.Enkhbayar who did not attend the previous hearing due to poor health, attended the trial this time. Ten minutes before the start, N.Enkhbayar arrived in an ambulance from Clinical Hospital II, accompanied by nurses and personnel from the Court Decision Implementation Office. When he came out of the emergency vehicle, his party members and supporters chanted “Truth will triumph, you will win, and we will support you”.
The Police notified the gathered members of his party that they would not be able to attend the trial because the Sukhbaatar District Criminal Case Courtroom has a capacity of only 21 people. N.Enkhbayar’s son E.Batshugar, the General Secretary of MPRP N.Udval and Board Member of MPRP L.Tsog were allowed to attend the trial along with few people from the press.
The trail was opened at 10:10 by the court secretary. N.Enkhbayar, D.Chuluunbat, J.Myagmarjargal and D.Dulamsuren were accused of violating Criminal Law, Section 263.2 and 150.3.
N.Enkhbayar requested that the trial be postponed because he is refusing to be defended by L.Shinen, B.Ganbaatar and wishes to chose another lawyer, B.Oyunbileg as his attorney. He also claimed he was not able to study the case files due to his poor health. Lawyer B.Oyunbileg who studied the condition of the Tuv Province Detention Centre where N.Enkhbayar was detained, stated that he had not studied the case files. After the request the trial took a short break.


After the break at 10:45, the court decided to accept N.Enkhbayar’s request and set the date of the trial on June 12th at 10 a.m.
Judge S.Soyombo-Erdene stated, “Your request is in accordance with legal policy therefore we accept. The newly appointed lawyer B.Oyunbileg has to complete the study of the case files by the deadline, and that applies to N.Enkhbayar as well. The next trial will not accept the excuse of not having finished studying the case files.”
Lawyer B.Oyunbileg stated, “A third party is not allowed to interfere with the election committee and its proceedings, but the General Election Committee has denied my client to enter the elections as a candidate, on the request of Deputy Head of Ulaanbaatar City Prosecutor’s Office Ye.Sagsai and the General Judge of Sukhbaatar District Court S.Soyombo-Erdene.”
Attorney Jim Odis of an American law firm was present during the trial as an observer and he has answered some questions.
-Can you introduce yourself? And have you come to attend the trial?
-My name is Jim Odis. I am a lawyer, I have my own firm. I’m from USA, Atlanta. I came to the trial today as an international observer at a request. You could say that I came to study the legal proceedings and environment in Mongolia.
-You said at a request. May I ask whose request?
-I came at a request from a law firm in US. I did not come at the request of any politician or a party and I do not receive any payment for this. I am very interested in civil and criminal cases in the world. Since I specialize in this field my job is to observe and study legal environments and proceedings. I came to note whether the court and legal proceedings are in accordance with the law.
-Where else have you worked as an observer?
-I have worked as an official observer in Syria, Africa, Denmark and Egypt.
-Will you be observing the trial eight days from now?
-I can’t say for sure.
-You have witnessed the trial of someone who was the President of Mongolia. What is your impression?
-I think the court procedure was very fast. My impression is that the preparation wasn’t sufficient.
-Have you studied the case? Do you have any information about this case?
-Of course I studied the necessary information. I also read many articles and talked to people about the case and assessed the facts.
-And what is your impression?
-I can’t pass judgement at the moment. I need time and more information.
-Are the people with you also international observers?
-Yes, they are also lawyers.

It seems to me that he is being hired by Mongolian People's Revolutionary party. What a rich lawyer? Who wants to travel around the world and to see what is happening in a court room on his or her finance? Obviously, he is lying to us. Who is sending wrong information to some western country such as Canada, USA and Australia? I heard someone talking about Enkhbayar on a radio in Australia and explaining that he is accused of privatizing a small hotel in Mongolia. I don't think Ekhbayar is innocent as well as I don't know how many bad things he has done to Mongolians. According to Mongolian Law, if someone acts against a law, the person must be punished. I hope that Mongolian court will judge him properly.

I am honoured to have Ambassador Jambaldorj share my concerns regarding this trial. It will be interesting to see what happens when the trial resumes. With all due respect as a former Senior Advisor to former Prime Minister Bayar you and all former MPRP and now MPP members and associates know very well the extent of Enkhbayar's wealth and what he has done to the Mongolian people. I hope that the Mongolian legal system will deal with him properly.

Who is Jim Odis and what is the name of his law firm? If he was sent by an American law firm what is the name of that firm? Given that the former Secretary of State James Baker has a law firm that works for Ivanhoe mines these questions need to be asked.
Are we to believe that he likes travelling the world at his own expense to "observe" trials?
Is the company that sent him involved in the mining industry? Calling yourself an international observer doesn't mean that you are legitimate just because a private law firm supposedly sent you. Why is he allowed to speak in court? If he came to see if the proceedings are in accordance with the law which law does he mean the supposed new law from Chimids cut and paste new constitution of 1993 or the real law of Mongolia ie. the inquisitorial, draconian and corrupt one?
This has a bad smell to it.
